Before taking classes at Pole & Aerial, please read our Terms & Conditions carefully. These Terms & Conditions govern your use of our website, as well as all services and products provided by us. By using our website or taking any of our classes, you agree to be bound by these Terms & Conditions, so please read them carefully before proceeding.

By enrolling in, booking or purchasing items from Muse Pole Studio; you hereby agree, accept and acknowledge all of the following terms and conditions.

SAFETY & LIABILITY

MUSE Pole Studio takes all reasonable care in the conduct of its business. By entering into classes, workshops and courses organized by MUSE Pole Studio at any venue or event that MUSE Pole Studio is located; you agree that MUSE Pole Studio, its instructors, and Theresa Olsen as an individual is in no way responsible for injury or fatality caused during your participation. By signing this document you hereby acknowledge that you understand that pole dancing can be an extreme activity that may be physically strenuous and that you are participating voluntarily with full knowledge that you are liable to bruising, skin burns & sores, injuries or fatality; you cannot hold MUSE Pole Studio or any of its instructors liable for these injuries or any other injuries caused during classes. You are participating at your own risk and can opt-out or request an alternative movement at any time. You are responsible for ensuring that you are physically and medically fit for the class/coaching session that you are attending/have attended with MUSE Pole Studio. During the class you must always take care of your own personal safety and inform the instructor of any physical limitations you may have. Should you have a pre-existing medical condition or in doubt as to your suitability for this program, MUSE Pole Studio and its instructors recommend you consult your physician for medical clearance. It is not advisable for pregnant women to participate in a pole dancing program; therefore, participation by persons in this condition is at their own risk. You agree that you will not sue or make any other claims of any kind whatsoever against MUSE Pole Studio or Theresa Olsen as an individual; for any personal injury, property damage/loss, or accidents resulting in death.

DRUGS & ALCOHOL

It is prohibited to drink alcohol, or take drugs prohibited by law, before or during any pole dancing lessons and activities conducted or organized by MUSE Pole Studio or any other person authorized to instruct/coordinate. If you are taking medications that cause dizziness, vertigo or other side effects that could influence your physical performance; you must advise your instructor and take responsibility for your voluntary involvement in any classes/performances/activities conducted or organized by MUSE Pole Studio or any other person authorized to instruct/coordinate.

STUDENT INSTRUCTING POLICY

Any students that take actions to instruct another student; whether it be verbal cueing, demonstrating tricks or spotting, without the consent of the class instructor can be asked to remove themselves from the class or the studio without entitlement to a refund. Our instructors are specifically trained to instruct safely, and we take our students safety very seriously.

PERSONAL BELONGINGS

You must monitor the safekeeping of personal belongings while attending class, as MUSE Pole Studio and its instructors does not take responsibility for lost or stolen property.

PRIVACY POLICY

All personal information collected by MUSE Pole Studio will be used solely by MUSE Pole Studio to conduct our business. Your information will not be disclosed to any third parties, other than for the purpose of online bookings for processing payments. We will not ask for personal information that is not relevant to our business operations. MUSE Pole Studio complies with Australia’s privacy laws and ensure our privacy policy is up to date with our legal requirements.

PAYMENT POLICY

Course fees are to be paid upfront prior to attending a Muse Pole & Aerial classs or workshop or event. We are not required to provide refunds if you are unable to attend your class/course/workshop, due to reasons beyond our control. Upon cancellation you forfeit the full payment for your course/class/workshop. Refunds or ‘make up classes’ may be approved under special circumstances at the discretion of Theresa Olsen, owner of MUSE Pole Studio. No other Instructor or staff member can grant these permissions. MUSE Pole Studio holds the right to reschedule class dates on the rare occasion that an instructor is not available or any other reason beyond the control of the studio; in this circumstance your class will be rescheduled, and no refund will be provided.

GIFT CERTIFICATE

Gift certificates are not redeemable for cash. The certificate will hold no value after the expiry date stated on the certificate; they must be used within 6 months of purchase and will not be extended. It is the certificate holders’ responsibility to contact MUSE Pole Studio to book. It is the certificate buyers’ responsibility to ensure the recipient is aware of these terms and conditions. Certificates that have been altered or tampered with will be declined and hold no further value. Booking times do vary and are subject to availability. Certificates must be redeemed by the name it has been addressed to unless the ‘to’ section was is blank.

MODEL RELEASE

In consideration of your engagement as a student, you hereby grant the following rights and permissions to MUSE Pole & Aerial, any heirs, legal representatives, and assigns, and photographer or videographer, and attendees of MUSE Pole & Aerial, authority and permission to take, use, re-use, publish, and republish photographic pictures or video footage of you or in which you may be included, in whole or in part, without restriction as to changes or alterations, for distribution on the internet and print, for illustration, promotion, art, editorial, social, advertising. You hereby waive any right that you may have to inspect or approve the finished product for publish. You hereby release, discharge, and agree to hold harmless, MUSE Pole & Aerial owners, heirs, legal representatives, and assigns, and all persons acting under her permission or authority, from any liability that may occur in the taking of such photographs or video footage, including without limitation any claims for libel or violation of any right of publicity or privacy.
